Terms of Service
Hitme is a productivity app with a simulated blackjack mechanic. You bet minutes of screen time, never real money. The optional Pro subscription buys app features (more games, more slots, themes, advanced stats) — never playable currency. Don't break the law, don't try to break the app, and use it at your own risk. The full text below covers everything else.
01The agreement
These Terms of Service ("Terms") are a binding agreement between you and the developer of Hitme ("we," "us," "Hitme"), reachable at devwriterco@gmail.com. By installing, opening, or using the Hitme app (the "App") or this website (the "Site," together the "Service"), you agree to these Terms. If you don't, don't use the Service.
02Eligibility
You must be at least 13 years old (or 16 in jurisdictions where that is the relevant threshold) to use the Service. The App contains simulated gambling-themed mechanics (blackjack against a virtual dealer) but at no point involves real-money wagers, real-money payouts, or any form of gambling regulated under applicable law. If you are under the age of legal majority in your jurisdiction, you must have a parent or guardian's permission.
03License (End-User License Agreement)
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of the App on a device you own or control, for your personal, non-commercial use. This license is granted by us to you and is separate from the App Store / Play Store license terms (Apple's "Licensed Application End User License Agreement" and Google Play's terms apply additionally where relevant).
You may not: (a) reverse engineer, decompile, or disassemble the App except to the extent local law expressly permits; (b) modify, adapt, or create derivative works; (c) remove or obscure any copyright, trademark, or proprietary notices; (d) rent, lease, sell, sublicense, or distribute the App; or (e) use the App in any manner that violates law or these Terms.
All right, title, and interest in and to the App, including all intellectual property rights, remain with us and our licensors. Nothing in these Terms transfers any ownership.
04Nature of the game
No real money. The "currency" inside the App is screen time on apps you have voluntarily chosen to block. You are never depositing, wagering, or winning real money or anything redeemable for real money. There is no withdrawal, no cash-out, no peer-to-peer betting, and no ability to convert in-game balance into anything outside the App.
No purchasable currency. We do not sell chips, tokens, time, or any other in-game currency. The only paid product is Hitme Pro (see §5) and the optional Lifetime plan (§6), both of which buy features — not playable balance.
Simulated blackjack. The game uses standard blackjack mechanics (single deck, dealer hits soft 17, blackjack pays 3:2, no insurance, no surrender, split is deferred to a future version). Outcomes are determined by a cryptographically seeded RNG. Past outcomes do not influence future outcomes.
05Hitme Pro — subscription terms
Hitme Pro is an optional auto-renewing subscription that unlocks additional features (Degen Mode, additional games as released, unlimited blocked apps, advanced stats, cosmetic themes, custom rules). Pricing is shown in-app at the moment of purchase and may vary by region or platform.
Indicative prices (USD; actual price shown in-app):
- Monthly: $4.99 / month, billed monthly.
- Yearly: $24.99 / year, billed annually.
Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price unless canceled at least 24 hours before the end of the period. Payment is charged to your Apple or Google account at confirmation of purchase and at each renewal.
Cancellation. You can manage and cancel subscriptions at any time in your Apple or Google account settings. Cancellation takes effect at the end of the current billing period; you keep Pro features until then.
Free trials, if offered, automatically convert to paid subscriptions at the end of the trial unless canceled at least 24 hours before the trial ends.
06Lifetime plan
The Lifetime plan is a one-time purchase that grants Pro features for the lifetime of the App. "Lifetime" means: as long as Hitme remains operational and continues to be distributed by us. If we cease operations, are acquired and the App is discontinued, or are forced to take down the App for legal reasons, the Lifetime entitlement ends with the App. Lifetime is a non-recurring purchase — there is no auto-renewal.
Lifetime entitles you to all features included in Pro at the time of purchase, plus all future Pro features that we ship as part of the Pro tier. We reserve the right to introduce a separate, higher tier in the future that is not included; in that case Lifetime continues to include everything previously promised.
07Refunds
All purchases are processed by Apple or Google. Refund decisions are governed by their policies:
- Apple: request a refund at reportaproblem.apple.com.
- Google Play: request a refund via the Play Store within the eligible window, or contact Play support.
We do not directly process payments and cannot issue refunds outside of Apple/Google channels. Statutory consumer-protection rights (e.g., EU 14-day withdrawal) apply where required by law.
08Acceptable use
You agree not to:
- Tamper with, jailbreak, or modify the App to gain unauthorized features or balance.
- Use automated tools, scripts, or accessibility-service abuse to circumvent the block enforcement.
- Attempt to extract, copy, or reverse-engineer the blackjack engine.
- Use the App in any way that violates law, regulation, or platform terms.
- Misrepresent the App, including by reuploading or rebranding it.
09Availability and changes
We may add, modify, or remove features at any time, including features previously available in the free tier. We will not, however, remove a feature you specifically paid for under a Lifetime entitlement without offering equivalent functionality or a pro-rata refund where required by law.
The App may be unavailable from time to time for maintenance, updates, or reasons outside our control. Because the App is offline-first, most outages will not affect gameplay — only subscription validation and waitlist signup require connectivity.
10No warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THAT THE BLOCK ENFORCEMENT WILL PREVENT ALL UNDESIRED APP USE; OS-LEVEL CHANGES, USER ERROR, AND DEVICE-SPECIFIC BEHAVIOR MAY DEFEAT IT.
11Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US (THROUGH APPLE OR GOOGLE) FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the smallest amount permitted.
12Indemnity
You will indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service in violation of these Terms, (b) your violation of any law, or (c) your violation of any third-party right.
13Termination
You may stop using the Service at any time by uninstalling the App. We may suspend or terminate your access if you breach these Terms or if continued provision is impractical. Sections that by their nature should survive termination (license restrictions, IP, disclaimers, liability, indemnity, governing law) survive.
14Governing law and disputes
These Terms are governed by the laws of the developer's place of residence, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of competent jurisdiction in that place, except where applicable consumer-protection law gives you the right to bring proceedings in the courts of your own residence — in which case those rights are not affected.
If you are an EU consumer, the European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not, however, obliged to participate.
15Changes
We may update these Terms. Material changes will be flagged with a revised "Last updated" date and surfaced in-app on your next launch. Continued use after the change constitutes acceptance.
